Nevada SB 260 (2025) added NRS 618.297, whose statutory employer duties took effect 2026-01-01, and directed the Administrator of the Division of Industrial Relations to make implementing regulations. The implementing regulation, LCB File R070-26, sets exactly two AQI-for-PM2.5 thresholds: at AQI 150 or above, attributable to wildfire smoke, the employer must implement engineering, administrative and PPE controls, provide NIOSH-approved N95 filtering facepiece respirators for voluntary use, operate a two-way exposure communication system and train employees; at AQI 500 or above the employer must not allow employees to perform the 'critical tasks' identified in its written safety program outdoors. R070-26 IS STILL PROPOSED, NOT ADOPTED — hence legalStatus proposed_rule.

Exactly two thresholds, which is itself a verified finding: the dossier's open question 3 asked whether an intermediate AQI 200 tier existed, and reading both draft versions end to end resolved it in the negative. Do not add a 200 tier from the NRS 618.297(1)(a) statutory wording — that wording delegates to the Administrator, who regulated both bands with one set of measures.
The AQI 500 figure is a CRITICAL-TASK restriction, not a stop-work threshold: it bars only those tasks the employer has identified as critical in its own written plan, which this calculator cannot know, so it is reported as a duty and never computed as a work stoppage. This is structurally different from Cal/OSHA §5141.1's AQI>500 mandatory-respirator-with-fit-testing mechanism and must not be conflated with it.
